The Carrier will not be responsible for damage caused by leaking fluids, battery acids, cooling system antifreeze, rock chips, acts of God, vandalism, damage caused by freezing of cooling system and/or batteries, mechanical functions (including alarms), alignment, suspension, exhaust assembly, antennas that do not retract to within three inches of vehicle body, windshields that crack due to previous existing chips or extreme changes in weather conditions, convertible tops that are loose, torn, or have visible wear, vehicle caps, masks, bras or any other type of canvas material covering.
Also Jane said she didn't know we were a broker. In the first paragraph of our email the following is stated:

He called us every week and we told him that we couldn't find a carrier as it was extremely busy coming out of Arizona. He also contacted us by email several times during that time. We added our commission to the carrier pay to try and make it more attractive, but still were unable to move it. We suggested on at least 4 occasions that he should see if he could find someone else to move it as we had done all that we could. He insisted that we had to do it and was uninterested in adding any money. We said we would continue trying. Why did Mr. Wheelock not try another company? I am sure he did, without any success. Why else would he fly down and drive it home? I'm also sure he gave the other companies the same kind of review. There were several hundred cars coming out of Arizona at the time. Many of them well past their scheduled pick up dates. Mr. Wheelock's deposit was refunded immediately upon cancellation.
FYI the following was in Mr. Wheelock's contract:
4. There are situations where we are unable to find a carrier to move a vehicle. If for any reason we are unable to schedule your vehicle, any monies that we have received are fully refundable. However, we will continue to schedule it until we are advised otherwise.
We do all we can to move every vehicle, but as with every company we do not have a perfect record. Last year we moved over 95% of our orders. I doubt that any other company can say the same.

Try to give us at least a 3 day window to pick up your vehicle. (This means that your vehicle should be available for a 3 day time period.) It doesn’t mean that you have to stay home for 3 days. THIS WINDOW IS NOT GUARANTEED. Please have an alternate person to release you vehicle should there be a delay.
It also said the following:
The deposit (broker fee) for your transport is fully refundable until your vehicle has been scheduled on a Carrier. Cancellation of order must be in writing by e-mail or fax.
When he placed the order the following email was sent to him. It read as follows:
We understand that your 2009 Toyota Prius will be available for pickup on or after 4/30/2010. Be sure to have an alternate pick up contact should we be unable to meet your pick up window.
Mr. Moselina never cancelled the order by e-mail or fax. Mr Moselina didn't have an alternate person to release his vehicle. If he had cancelled before the scheduling he would have been refunded. Mr. Moselina thinks he can make his own rules. Unfortunately all carriers run into delays at times. That is why our window is not guaranteed. A 2 or 3 day delay is not uncommon in the transport business.
Finally, Mr.Moselina was never told by me that he was on his own. That is an outright lie! His car would have been picked up on 5/5 or 5/6 if he had not gone with another carrier. That is a 2-3 day delay.

I am sorry that we were unable to move your vehicle. The following suggestions (not terms and conditions} were included with your quote:

This window is not guaranteed, so please have an alternate person to release you vehicle should there be a delay. You will be notified ahead of time by the driver or dispatcher as to which day. If you need the vehicle until right before you leave, we suggest you leave it with a neighbor, friend or relative in the area, to be picked up after you leave.
3. Unfortunately, as with every form of transportation, we have to deal with various uncontrollable situations (such as bad weather, breakdowns, traffic, sickness, etc.) which affects the pickup window and delivery estimates. However, we try to keep on schedule whenever possible. We suggest that you have an alternate person to release or receive your vehicle should this occur.
4. In the rare occasion that we are unable to schedule your vehicle, any monies that we have received are fully refundable. However, we will continue to schedule it until we are advised otherwise.
As you know we are a broker and do not control the carriers that we use. We have used xxxx Express since 2004. We have never had a problem with them. Their record with the broker dispatch board is also very good. We have no way of anticipating a problem. The only thing we can do when the carrier is late is try to reschedule. To blame us for the carrier dropping the ball is like blaming your travel agent for your plane flight being late or cancelled. Once we found out that the carrier was not picking up you car, we immediately tried to reschedule. You gave us 5 hours and then you cancelled the order. We had another carrier who could have picked up your car today (6/25), but you never gave us a chance. What did you expect us to do? As we say in our advertising we move 95% of our orders. We never said 100% as we know the problems do happen and that no company in the country moves all their vehicles. We have refunded you deposit (which you gave to us on-line. We did not immediately take it out as you stated.) It is also untrue that Ryan did not try to contact xxxx Express. He was waiting for them to return the call before he could call you back with the status. It is also untrue the Ryan promised you anything. My representatives are told not to promise or guaranteee anything. I understand you are upset, however there was never any prevarication done by our company. I don't appreciate your misrepresentation of our company. Your complaints will be addressed. Honesty will prevail!
